PRAYER: Writ Petitions filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to pass final orders pursuant to the enquiry held under the charge memo issued by the 2nd respondent vide his proceedings in Ku.Ku.No.Pani-2(1)/1678689/2023 dated 09.11.2023 within the period that may be stipulated by this Court. The petitioner is working as Personal Assistant to the District Collector, Tenkasi. He was issued with a charge memo on 09.11.2023, on certain allegations. Enquiry has also been concluded and a report has been filed by the Enquiry Officer, based on which, a second show cause notice was issued to this petitioner. However, the Additional Chief Secretary, Commissioner of Revenue Administration /the second respondent herein has not taken any decision based on the enquiry report as well as on the reply submitted by this petitioner. Therefore, this petitioner has been deprived of his promotional opportunities. Hence, the petitioner has approached this Court, seeking a Writ of Mandamus in the nature of direction, directing the second respondent to conclude the disciplinary proceedings within a stipulated time. 2.Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice for the respondents and submits that on completion of the enquiry, enquiry report has been submitted to the Disciplinary Authority, based on which, a second show cause 2/5

notice was issued to this petitioner on 02.12.2025. The petitioner has also offered his explanation. The second respondent is yet to take a call on the disciplinary proceedings.

3.The Government has issued compendium of instructions in dealing with the disciplinary proceedings in G.O.Ms.No.81, Human Resources Department, dated 04.08.2022 prescribing time limit for finalising the disciplinary proceedings. 4.In view of the above, this writ petition is disposed of with a direction to the respondents to conclude the disciplinary proceedings as per the aforesaid Government Order, within a period of four weeks from the date of receipt of a copy of this order. No costs.
