ORDER

This Criminal Original Petition has been filed to direct the learned Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Dindigul, to consider the bail application of the petitioner on the same day of their surrender before that Court in connection with Crime No.2/2026 on the file of the 2nd respondent police.

2. Since there is no adverse order passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. The learned counsel for the petitioner submitted that, during the New Year celebrations, the defacto complainant had organised annadanam at the Sri Bhagavathiyamman Temple. At that time, a minor dispute arose between members of the defacto complainant's community and certain others. However, the issue 2/5

was amicably resolved. It is further alleged that, in connection with the said New Year incident, the accused assaulted the defacto complainant, used abusive and offensive language, and criminally intimidated him. The defacto complainant is stated to have sustained a bleeding injury and was immediately taken to the Government Hospital for treatment. Thereafter, he lodged a complaint before the second respondent police, based on which an FIR came to be registered against the petitioner.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Judge, Special Court for Exclusive Trial of Cases under SC/ST (POA) Act, Dindigul, to issue prior notice to the de facto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.2 of 2026 on the file of the 2nd respondent police. The petitioner shall surrender before the 3/5

learned Trial Court within a period of 15 days from the date of receipt of a copy of this order.
