Heard the learned counsel on either side.

2. The petitioner is figuring as accused No.3 in C.C.No.16 of 2010 on the file of the Special Judge(Special Court) under TNPID Act Cases, Madurai. The petitioner filed a petition under Section 5-A of the TNPID Act and the same was returned. Challenging the same, this Criminal Original Petition has been filed.

3. In the meanwhile, the petition under Section 5-A of the Act was numbered and it is still pending. The Court below is directed to dispose of the said petition on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. Till the petition filed under Section 5-A of the Act is decided, the appearance of the parties before the Court below is dispensed with. If the petition is allowed till the report is received from the competent authority, the relief of dispensed with https://hcservices.ecourts.gov.in/hcservices/ 1/2

the personal appearance of the petition can continue. 4.This criminal original petition is disposed of.
