O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to defreeze the petitioner's Savings Bank Account No. 32390189220.

2. Mr. T. Palanisamy, learned counsel for the petitioner, submitted that the petitioner's bank account was frozen on the ground that a sum of Rs. 10,000/- had been fraudulently transferred to his account and that the said transaction is under investigation.

3. Mr. N.S. Karthikeyan, learned counsel for the respondent, submitted that the petitioner's bank account was frozen in view of the pending investigation.

4. I have considered the submissions made on either side.

5. It is not in dispute that the bank account has been frozen alleging that a sum of Rs.10,000/- has been fraudulently transferred to the petitioner's 2/4

bank account. In such circumstances, it would suffice if the petitioner is permitted to operate the bank account, subject to the respondent marking a lien for a sum of Rs.10,000/-.

6. Accordingly, the Writ Petition is allowed to the limited extent that the respondent shall mark a lien for a sum of Rs.10,000/- in the petitioner's bank account and permit the petitioner to operate the account for the remaining balance. No costs.
