ORDER

The present writ petition has been filed seeking a mandamus forbearing the second respondent from shifting the existing high tension electrical transformer which is located at a distance of 10 feet in Madurai Batlangundu road to 5 feet distance of the petitioner's building situated in door No.1A/11 in Ward No.9 of EB Colony, Nilakottai Taluk, Dindigul District.

2. The learned Counsel appearing for the writ petitioner submitted that due to widening of the road by the first respondent, the second respondent is attempting to shift the transformer very close to his property and this may cause disturbance to his property and future development.

3. The learned Additional Government Pleader appearing for the first respondent has received written instructions to the effect that the transformer would be put up 13 feet away (horizontal distance) from the property of the writ petitioner in the highways land.

The written instruction is taken on record and in view of the said written instructions, it is clear that the first respondent is going to shift the transformer which will be 13 feet away(horizontal distance) from the petitioner's building. In such circumstances, the grievance of the petitioner has already been alleviated and therefore, no further orders are called for in the writ petition.
