Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who are arrayed as A4 to A6 apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 447 of IPC and Sections 3 and 4 of Tamil Nadu Prohibition of Exorbitant Interest Act, 2003 and Section 4 of Tamil Nadu Prohibition of Women Harassment Act in Crime No.159 of 2015 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the de facto complainant had borrowed a sum of Rs.2,75,000/- from the accused 4 and 5 and even after repayment of the Rs.

5,90,000/- the accused threatened the de facto complainant to pay more interest or sell her property. 3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the co-accused / A1 and A2 were already arrested and released on bail and that the petitioners are family members of A1 and A2.

4.Heard the learned Government Advocate (Crl.side) would submit that the case of the investigation is pending.

5. Considering the facts and circumstances of the case and also considering the fact that the co-accused had already released on bail, I am inclined to grant grant anticipatory bail to the petitioners. Accordingly, the petitioners are ordered to be https://hcservices.ecourts.gov.in/hcservices/

released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Nilakkottai and on each of them are executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the 1st and 3rd petitioner shall appear before the respondent police as and when required for interrogation and the 2nd petitioner shall appear before the respondent Police daily at 10.30 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
