O R D E R

This Criminal Original Petition has been filed to direct the second respondent herein to register a case on the complaint of the petitioner, dated 31.07.2017.

2. According to the petitioner, the proposed accused has bought a total sum of Rs.5,73,000/- to erect the mobile tower in the his locality and there is no response from the proposed accused and also received a communication that he has no approval form the Tele Communication Department. Hence, the petitioner has filed a complaint. Since no action has been taken, the petitioner filed this Criminal Original Petition.

3. The learned Additional Public Prosecutor has submitted that the enquiry is still pending.

4. Considering the fact that the enquiry is still pending, the respondent police is directed to enquire the complaint. After enquiry, if any cognizable offence is made out, the respondent police is directed to register a case and proceed in accordance with law.

5. With the above direction, this Criminal Original Petition is disposed of.
