PRAYER: Criminal Original Petition filed under section 482 of the Code of Criminal Procedure, praying to direct the respondent No.1 to withdraw the case in Crime No.22 of 2014 on the file of the 6th respondent and entrust the same to the second respondent to complete the investigation and file charge sheet before the Jurisdictional Magistrate in accordance with law within the stipulated by this court.

O R D E R

The petition has been filed, seeking a direction to quash C.C.No.90 of 2014 on the file of the learned Judicial Magistrate No.I, Madurai.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents and perused the materials available on record.

3. Perusal of the counter affidavit filed by the sixth respondent shows that some of the accused have been arrested on 05.07.2015 for the offences under Sections 294(b), 323, 506(i) IPC@ 174 Cr.P.C. which has been altered to 294(b), 323, 506(i) IPC and 302 of IPC in Crime No.22 of 2014 on the file of the sixth respondent and the said respondent is waiting for the final report of the chemical examination of the body parts of the petitioner's husband.

4. Considering the facts and circumstances of the case, this court is not inclined to transfer the investigation and finds that it is appropriate to direct the fourth respondent to monitor and supervise the investigation in Crime No.22 of 2014, as the complaint is of the year 2014 and the second respondent is directed to file the final report, under the supervision and monitoring of the Superintendent of Police, Madurai, within a period of four months from the date of receipt of a copy of this order.

5. Accordingly, this Criminal Original Petition is disposed of.
