To set aside the against the decree and judgment passed dated 24.02.2016 made in A.S.No.56 of 2014 on the file of the II Additional District and Sessions Judge, Thanjavur, Thanjavur District confirming judgment and decree passed dated 11.09.2014 made in O.S.No.95 of 2007 on the file of the Learned Principal Subordinate Judge, Kumbakonam, Thanjavur District. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.G.GOMATHI SANKAR, Advocate for the petitioner, the court made the following order:- This petition has been filed by the petitioner seeking to condone the delay of 910 days in re-presenting the Second Appeal. 2.Heard the learned counsel for the petitioner. 3.
Considering the reasons stated in the affidavit filed in support of the petition and also considering the length of delay, this Court is inclined to condone the delay subject to the payment of cost of Rs.1000/- (Rupees one thousand only) to the Legal Aid Service Authority, attached to this Bench, on or before 28.04.2021, failing which, the petition shall stand dismissed automatically without any further reference to this Court.
