Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who is arrayed as A1, apprehends arrest at the hands of the respondent police for an alleged offence punishable under Sections 341,323,324 and 506(ii) of IPC in Crime No.97 of 2015, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused alleged to have attacked and criminally intimidated the de facto complainant.

3. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. side) appearing for the respondent.

4. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that co-accused have already arrested and released on bail in Crl.M.P.No.2106 of 2015 dated 23.04.2015.

5. The learned Government Advocate (Crl. Side) would submit that the injured has been discharged from the hospital. https://hcservices.ecourts.gov.in/hcservices/

6. Considering the facts and circumstances of the case and also considering the fact that the co-accused have already released on bail, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Thirumayam, Pudukkottai District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
