ORDER
This Criminal Original Petition has been filed to direct the respondents not to harass the petitioner and his family members under the guise of enquiry since the same is subject matter of the suit in O.S.No.322 of 2014 on the file of the District Munsif Court, Melur.
2. Heard the learned counsel appearing for the petitioner and learned Additional Public Prosecutor appearing for the first and second respondents.
3. The learned Additional Public Prosecutor has submitted that a complaint has been received from the third respondent and asked the petitioner to appear for enquiry. But, he did not appear before the respondent police and hence, the petitioner filed this Criminal Original Petition not to harass the petitioner and his family members. petitioner can also very well place the documents before the second respondent.
4. He further submitted that earlier, for the very same allegation, the petitioner has already filed a petition in Crl.O.P. (MD)No.17134 of 2015 by seeking a relief not to harass the petitioner and his family members and subsequently, this Court, by an order dated 03.09.2015, granted the relief that the respondent shall not harass the petitioner and if the police want to interrogate, it is open to the police to issue summon to the petitioner.
5. In view of the aforesaid submission made by the learned Additional Public Prosecutor, the petitioner shall appear before the respondent police and place all the relevant documents. It is open to respondent police to issue summon, if necessary. With the above direction, this Criminal Original Petition is disposed of.
