Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.4 in Crime No.2 of 2015 on the file of the file of the respondent police apprehends arrest for the offences under Sections 408,477(A) r/w 109 IPC and seeks anticipatory bail.
2. It is the case of the prosecution that the accused have misappropriated a sum of Rs.3,475/- in Odaipatti Primary Agricultural Co-operative Society by forging documents.
3. The learned counsel for the petitioner submitted that the petitioner was working as a salesman in the Society and he is falsely implicated in this case. It is further submitted that A1 to A3 in this case were already granted anticipatory bail.
4. The learned Government Advocate (crl. side) would submit that the accused have remitted the entire amount on 28.12.2014 and the major part of the investigation is over.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Madurai and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
