ORDER

This petition has been filed for issuing a direction to the 3rd respondent herein not to harass the petitioner on the basis of the complaint given by the 4th respondent, dated 13.02.2023.

2. The grievance of the petitioner is that she purchased the property from the 4th respondent through sale deed dated, 15.09.2022 and also received sale consideration. After that she was in possession of the property, now, the 4th respondent is claiming additional sum of Rs.5,00,000/- and that he has also given a complaint before the third respondent, upon which the third respondent has issued a summon to the petitioner.

3. The learned Public Prosecutor appearing for the 2/5

respondents police would submit that on the basis of the complaint given by the 4th respondent enquiry in CSR.No.250 of 2022 was undertaken and during the course of enquiry, the petitioner has given an undertaking that she will pay the balance amount.

4. Perusal of the enquiry report shows that originally this petitioner only gave a complaint stating that the 4th respondent refused to execute a sale deed. During the course of enquiry, both sides gave an undertaking that they resolved their issues between them. The petitioner herself stated that in respect of the above said issue case is pending and the same will be concluded in the month of June. In view of the above said compromise reached between the parties before the 3rd respondent, nothing survives for adjudication in this petition.

5. With the above observation, this Criminal Original Petition is disposed of.
