PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to take legal action in pursuant to the orders passed by the 2nd respondent in Na.Ka.No. 711/E1/2023 dated 11.05.2023 declaring the Document no. 390/1965 on the file 2/6
of Sub Registrar Office, Sowcarpet, Chennai and Document Nos. 1275 of 1965 and 1776 of 1965 registered on the file of Sub Registrar office, Chengalpattu as fake and fabricated documents by canceling the subsequent documents registered on the file of Joint Registrar I, Sub Registrar office, Thanjavur, in consideration of representation submitted by the petitioner.

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus directing the respondents to take legal action in pursuant to the orders passed by the 2nd respondent in Na.Ka.No. 711/E1/2023 dated 11.05.2023 declaring the Document no. 390/1965 on the file of Sub Registrar Office, Sowcarpet, Chennai and Document Nos. 1275 of 1965 and 1776 of 1965 registered on the file of Sub Registrar office, Chengalpattu as fake and fabricated documents by canceling the subsequent documents registered on the file of Joint Registrar I, Sub Registrar office, Thanjavur, in consideration of representation submitted by the petitioner.
2.The official Respondents are not having any power to conduct enquiry, since Section 77(A) of the Registration Act since the same has been stuck down 3/6
by the Court. However, the official respondents are having power under Section 83 of the Registration Act to take criminal action. The respondent shall consider the petitioner's representation under Section 83 of the Registration Act and pass appropriate orders in accordance to law. The said exercise shall be completed within a period of 4 months from the date of receipt of a copy of this order, after giving notice to all the parties involved in the issue. 3.With the above observations, this writ petition stands disposed of. No costs.
