ORDER : The Court Made the following order :- The petitioner, who is arrayed as A4 apprehends at the hands of the respondent police for the alleged offences punishable under sections * 120 (B)IPC, 9(B), 1(B)r/w 3 and 4 of Explosive Substance Act, 1908 in Crime No.463 of 2012 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that some explosive substance exploded in a closed petty shop and the articles kept in the shop were also damaged.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Criminal side) appearing for the respondent submitted that the petitioner is having three previous cases to his credit.

5.However, considering the facts the occurrence had taken place in the year 2012 and circumstances of the case and also considering the nature of the allegation made against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Dindigul and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily twice i.e. at 08.00 a.m. and 06.00 p.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
