ORDER

This Criminal Original Petition has been filed by the petitioner, to direct the second respondent to register a case, against the accused one Anandharasu, based on the complaint given by him, dated 24.12.2016.

2.The learned counsel appearing for the petitioner submitted that based on the false promise given by one Anandharasu, the petitioner and one Perumal have executed a sale deed, in favour of the said Anandharasu. He further submitted that the said Anandharasu, gave a promise that he will pay the sale consideration of Rupees One Crore, after registering the sale deed. Believing his words, the petitioner and the said perumal have executed a sale deed, in respect of their property in favour of the said Anandharasu and thereafter the said Anandharasu, failed to pay the sale consideration and thereby he cheated the petitioner and also the said perumal. He further submitted that without making proper enquiry, the second respondent has closed the complaint. https://hcservices.ecourts.gov.in/hcservices/

3.The learned Government Advocate (Crl.side), on the contrary submitted that after receiving the said complaint an enquiry has been conducted and it was found that the petitioner has received the entire sale consideration and accordingly, the complaint has been closed.

4.Recording the aforesaid submission of the learned Government Advocate (Crl.Side), this Criminal Original Petition is closed. It is open to the petitioner, to avail any other remedy available under the law.
