Respondent/Complainant Prayer :- This Petition is filed Under Section 482 of Criminal Procedure Code, praying to direct the learned Judicial Magistrate, Thirumangalam to expedite the trial in C.C.No.150 of 2013 within time frame as may be fixed by this Honourable Court. ORDER:- This Petition coming on for orders on this day and upon perusing the letter received from the Judicial Magistrate, Tirumangalam, in D.No.809/2019, dated:24.04.2019, this Court made the following order:
This Court, by an order dated 26.10.2017, directed the learned Judicial Magistrate, Thirumangalam to expedite the trial and dispose of the C.C.No.150 of 2013, pending on its file within a period of three months from the date of receipt of a copy of this order.
2. Since the trial could not be completed within the time stipulated by this Court, the learned Judicial Magistrate, Thirumangalam sought for extension of time and hence, the matter is listed before this Court.
3. On perusal of the request made by the learned Judicial Magistrate, Thirumangalam, it is seen that she was newly appointed in the Court and the earlier Presiding Officer issued a Non-Bailable Warrant against A1 to A6 and the same is not yet executed and the order passed by this Court also not brought to the notice of the learned Judicial Magistrate.
4. In the above circumstances, the time granted by this Court is extended by three months from the date of receipt of a copy of this order and the learned Judicial Magistrate, Thirumangalam is directed to take steps to execute the Non-Bailable Warrant issued against the accused and if the warrant could not be executed, the learned Judicial Magistrate, Thirumangalam is directed to split up the case and proceed with the trial in respect of the available accused.
