JUDGMENT
(Judgment of the Court was made by the Hon'ble P.VELMURUGAN. J.) Today when the matter is taken up for hearing, both counsel appearing on either side would submit that both the parties entered into compromise. A joint compromise memo signed by both sides as well as their respective Counsel, dated 27/10/2025 is filed before this Court, which reads as follows:- "It is submitted that, while the matter is pending, settlement was arrived between the Insurance Company and the claimant, as claimant had agreed to reduce Rs.4,00,000/- from the total award as the said amount was reimbursed through his medical insurance policy.
Accordingly now both the parties had agreed to pass the total sum of Rs.22,65,180/- along with accrued interest and costs as total award, by reducing Rs. 4,00,000/- from the award passed by the learned tribunal [Rs.26,65,180/-] Page No.2 of 5
Therefore, in the above terms, the petitioner/appellant Insurance Company as well as the 1st respondent, both are agreed to dispose this appeal by reducing the compensation to Rs.22,65,180/- from the award passed by the learned Tribunal [Rs.26,65,180/-]. 2.Recording the same, the impugned award of the Tribunal is modified to Rs.22,65,180/- from Rs.26,65,180/-. The first respondent/claimant is entitled to withdraw the amount as agreed in the terms of compromise, from the Tribunal by filing proper application. If any excess amount, the same shall be returned back to the appellant Insurance Company by the Tribunal. The terms of joint compromise memo, dated 27/10/2025 shall form part of this the order. 3.Accordingly, this Civil Miscellaneous Appeal is partly allowed. No costs.
