Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/accused No.1, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 324, 341 and 506(ii) of IPC, in Crime No.303 of 2017, on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that on 04.10.2017, the petitioner and the defacto complainant attended the hearing before the trial Court. After Court hearing, when they were returning, there was a wordy quarrel arose between the petitioner group and the defacto complainant. At that time, the petitioner/A1 attacked the defacto complainant with iron pipe on his head and caused grievous injury. A2 attacked the defacto complianant with stick and A3 scolded him in filthy language. Thereafter, the defacto complainant admitted in the hospital. On Complaint, case has been registered for the above said offences.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and prays for anticipatory bail.

including murder case and other criminal cases are pending against him. He further submitted that if the petitioner enlarged on anticipatory bail, he may tamper the evidence and witnesses or influencing the law enforcing agency.
5. Considering the facts and circumstances of the case and also considering the previous criminal cases pending against the petitioners, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
