ORDER : The Court made the following order :- The petitioners are arrayed as accused No.1 and 2. They were arrested and remanded to judicial custody on 05.01.2020, for the alleged offences under Section 392 of IPC @ 395 of IPC, on the file of the respondent police in Crime No.5 of 2020. They seek bail. 2.Totally seven accused were involved in lifting stray goats during the wee hours. Based on the vehicle number, these accused were apprehended. The petitioners herein were arrested on 05.01.2020, on the ground that the co-accused were released on anticipatory bail, hence, the present petition is filed. 3.

The learned Additional Public Prosecutor appearing for the State would submit that the petitioners and others used to lift the goats and sell it to the butcher shop. This is a continuous reoccurrence crime. After much difficulty they were apprehended, based on their vehicle number used during the crime. https://hcservices.ecourts.gov.

CRL OP(MD). No.4400 of 2020 4.Since the co-accused already released on anticipatory bail, absconded without complying the bail petition, necessary steps taken for cancellation of their bail and arrested them. In such circumstances, the apprehension of the learned Additional Public Prosecutor that if the petitioners are granted bail, they will also join with the co-accused and abscond is well found. Hence, this Criminal Original Petition stands dismissed.
