ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.143 of 2015 on the file of the respondent police apprehends arrest for the offences under Sections 379 IPC r/w. Section 21(1) of Mines and Minerals Act and seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
3. The learned Government Advocate (crl. side) would submit that the petitioner has illegally transported one unit of sand and that there is no previous case against him.
4. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten https://hcservices.ecourts.gov.in/hcservices/ Thousand only) with two sureties each for a like sum to thesatisfaction of the learned Judicial Magistrate, Theni, Theni
District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
