ORDER

Seeking quashment of final report in STC No.1151 of 2025 on the file of the learned Judicial Magistrate, Karaikudi, this criminal original petition is filed.

2. Since no adverse order is passed against the 2nd respondent, notice to the 2nd respondent is dispensed with.

3. The case of the prosecution is that the petitioners on 29.07.2024 at about 5.30 p.m., conducted a meeting in front of 100 Feet Road, Karaikudi during the occasion of Vinayagar Chaturthi without getting any permission, causing obstruction to the general public and disturbing the traffic movement, on the basis of which First Information Report in Crime No.305 of 2024 was registered as against the petitioners for the offences under Sections 189(2) and 292 of BNS, 2/6

2023 and the same culminated in laying a charge sheet in STC No.1151 of 2025 on the file of the learned Judicial Magistrate, Karaikudi.

4. The learned counsel for the petitioners categorically submitted that other than conducting a meeting, they have not done any harm or they have not even disrupted or obstructed the general public. They will also undertake that they will not conduct any such meeting in future without due permission.

5. The learned Government Advocate(Crl.Side) categorically contended that without obtaining permission, they have conducted a public meeting in traffic congested road and hence, sought for dismissal of criminal criminal original petition.

6. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the submission made by the learned counsel for the petitioners that the petitioners will not ever attempt to conduct any meeting without due permission, this Court required them to file an affidavit of undertaking that they will not conduct any public meeting, protest, demonstration or agitation without due permission from the competent authority. In this regard, undertaking affidavit has been filed by the petitioners today. Accepting the same, the final report in STC No.1151 of 2025 on the file of the learned Judicial Magistrate, Karaikudi is quashed.

8. Accordingly, this Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petitions are closed. 19.02.2026 NCC : Yes / No Index : Yes / No Internet : Yes/ No gbg 4/6
