ORDER : The Court Made the following order :- The petitioner, who is the sole accused in Crime No.58 of 2015 on the file of the respondent police, apprehends arrest for the offences under Sections 294(b) IPC and Section 4 of TNPHW Act and seeks anticipatory bail.

2. It is the case of the prosecution that on 04.02.2015, the accused misbehaved with the defacto complainant and also abused her in filthy language.

3. The learned counsel for the petitioner submitted that the defacto complainant and the petitioner are neighbours and there is a dispute with regard to the usage of drainage channel and on the date of occurrence, there was a wordy altercation and the petitioner has been falsely implicated in this case.

4. Heard the learned Government Advocate (crl. side) appearing for the respondent police.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Tenkasi and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
