interest at 12% per annum on the delayed payment of Compensation from the year 2003 towards the damage caused to the property in Survey No.973/2B, Kuthukalvalasai Village, Tenkasi Taluk, Tirunelveli District now Tenkasi District, as per Section 10(d) of the Indian Telegraph Act, 1885 in light of the representation dated 10.08.2021 within the time frame fixed by this Court.

ORDER

This Writ Petition has been filed seeking a direction to the respondents to pay compensation for a sum of Rs.30,00,000/-(Thirty Lakhs) along with the interest at 12% per annum on the delayed payment of compensation from the year 2003 towards the damage caused to the property in Survey No.973/2B, Kuthukalvalasai Village, Tenkasi Taluk, Tirunelveli District now Tenkasi District, as per Section 10(d) of the Indian Telegraph Act, 1885 in light of the representation dated 10.08.2021 within the time frame fixed by this Court.

2. The learned counsel appearing for the petitioner submitted that, despite the petitioner's objection made on behalf of his wife, the respondents, in the year 2003, trespassed into the petitioner's property and erected four poles for a high-tension power transmission tower, with 2/5

four transmission lines running across the property at a height of about 30 meters. It is further submitted that the petitioner made a representation dated 10.08.2021 to the respondents seeking payment of compensation in a sum of Rs.30,00,000/- together with interest at the rate of 12% per annum. However, the said representation has not been considered till date. Hence, the present Writ Petition.

3. Since no adverse orders are going to be passed against the respondents, notice to the respondents is dispensed with.

4. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the third respondent to consider the representation of the petitioner dated 10.08.2021 and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
