ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-3 in Crime No.16 of 2015 on the file of the respondent police was arrested and remanded to the judicial custody by the respondent police on 14.03.2015 for the alleged offence under Sections 66-C, 66-D of IT Act, 2000 and 420 I.P.C r/w 511 I.P.C @ 66-C, 66-D of IT Act, 2000 and 465, 468, 471 and 420 I.P.C r/w 511 I.P.C and hence seeks bail.
2. The case of the prosecution is that V.O.Chidambaranar Port Trust has decided to deposit surplus fund of Rs.10.50 Crores with the branch of Bank of India, Illipilli, Erode District and the amount was transferred through RTGS on 13.02.2015 and thereafter, the accused have conspired and attempted to transfer the funds to various individual accounts to misappropriate the fund.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence. He further submitted that the overt act attributed against the petitioner is that he filled up the cheques for transfer of the fund to various individual accounts. He further submitted that the main accused Nos.1 and 2 were arrested and released on bail in Cr.M.P.No.2726 of 2015 and 2727 of 2015 by the learned Judicial Magistrate No.I, Thoothukudi on 23.04.2015.
4. Heard the learned Government Advocate(Crl. Side).
5. Considering the above said facts, I am inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a https://hcservices.ecourts.gov.in/hcservices/
