ORDER : The Court Made the following order :- The petitioners, who are arrayed as A4 and A8 in Crime No.61 of 2015 on the file of the respondent police were arrested and remanded to judicial custody on 25.02.2015 for the alleged offences punishable under Sections 147,148,302 @ 147, 148, 120(b), 302 and 114 IPC, seek bail.

2.The case of the prosecution is that on 01.02.2015 there was quarrel in the liquor shop between the deceased Sakthivel and the accused Praveen, for which the case has been registered against both the groups and thereafter, on 22.04.2015 at 9.00 P.M the accused attacked the deceased with lethal weapons and caused his death. 3.The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the accused 6 and 7 who are similarly placed that of the 8th accused were already granted bail by this Court on 22.04.2015.

4. The learned Government Advocate (Crl.side) would submit that the 4th accused had stabbed the deceased on his stomach and backside which let to his death and 8th accused was watching the movement of the deceased.

5. The learned counsel for the seeks permission of this Court to withdraw this petition against the first petitioner / A4 and he has also made an endorsement to that effect.

6. In view of the endorsement, this Criminal Original Petition is dismissed as withdrawn against the first petitioner. 7.Considering the over tact attributed against the second petitioner/ A8, this Court is inclined to grant bail to the 2nd petitioner with certain condition. Accordingly, the 2nd petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate-III, Trichy and on further condition that the 2nd petitioner shall appear before the respondent Police daily at 10.00 a.m., until further orders.
