PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st and 3rd respondents to stop the work for construction of bridge which pave the way on the canal extending ion the petitioner's land in survey No.20/21 situated at Erkudi Village, Achampathu Panchayat, Madurai West Taluk, Madurai District constructed by the 4th respondent based on petitioner's representation dated 04.02.2026. ORDER

The present writ petition has been filed seeking a mandamus directing the respondents 1 to 3 to stop the construction work of the bridge over the canal on the ground that it extends into the petitioner's property in S.No.20/21 situated at Erkudi Village, Achampat Panchayat, Madurai West Taluk, Madurai District, on the basis of her application dated 04.02.2026.

2. According to the learned Counsel appearing for the writ petitioner, the petitioner has been granted with patta for 3.00 ares in S.No.20/21A2. Under the guise of putting of bridge, from Madurai to Theni road into Backiayalakshmi Nagar, the fourth respondent is attempting to encroach upon the property of the writ petitioner and therefore, the present writ petition has been filed. 2/6

The learned Additional Government Pleader appearing for the 4th and 5th respondents submitted that as per the 'A' Register as well as the patta standing in the name of the writ petitioner, the petitioner is entitled to only 7.5 cents. However, the petitioner is claiming more extent of land. However, the petitioner is not able to establish how she is the owner of 9 cents. He further submits that the 4th respondent is laying the bridge only excluding 7.5 cents of the petitioner which is covered in S.No.20/21A2.

4. I have considered the submissions made on either side and perused the materials available on record.

The learned Additional Government Pleader appearing for the 4th and 5th respondents has made a categorical submission to the effect that the petitioner's patta lands in S.No.20/21 A2 having an extent of 7.5 cents would not be disturbed. Without disturbing the frontage of her property, they are going to lay the bridge for the convenience of the large number of students who are admitted to a nearby school. Therefore, it is clear that as on today, whatever the petitioner owns as per the revenue records, her possession would be protected. 3/6

In case if the petitioner succeeds before the revenue officials in establishing that she is entitled to 9 cents instead of 7.5 cents, thereafter, proceedings could be initiated as against the official respondents for removing the bridge which may fall within her property due to the changes in the revenue records.

7. In such circumstances, there cannot be any direction to the respondents to stop the construction work as of now.

8. With the above said observations, this writ petition stands disposed of. No costs.
