....Respondents PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of mandamus directing the respondents to consider the petitioner's representation dated 11.11.2020 to initiate the mandatory procedures prescribed in the circulars, vide letter No.41530/U1/2017 dated 08.11.2017 and letter No. 41530/U1/2017, dated 31.07.2018 of Inspector General of Registration, Chennai 600 028, with respect to the property in ayan punjai Survey No.682/3, Thanthoni Village, Karur Taluk, measuring an extent of 1 acre 29 3⁄4 cents out of the 2.59 1⁄2 acres conveyed by the petitioner under the sale deed dated 25.3.1999 and registered as document No.1337 of 1999.

ORDER

This writ petition has been filed for issuance of writ of mandamus, directing the respondents to consider the representation made by the petitioner on 11.11.2020 and to initiate proceedings for cancellation of the documents pertaining to the subject property.

2. Heard Mr.P.Dhanasekaran, learned counsel for the petitioner and Mr.K.S.Selvaganesan, learned Additional Government Pleader for the respondents.

3. On carefully going through the materials placed before this Court, it is seen that the second respondent has already passed an order through proceedings dated 21.12.2020 rejecting the application given by the petitioner and directing the petitioner to approach the competent civil Court. This order has not been put to challenge and the petitioner has once again filed the present writ petition seeking for issuance of writ of mandamus. 2/4

4. The relief sought for by the petitioner is not maintainable, since the 2nd respondent has already passed an order. If the petitioner is aggrieved by the same, the order passed by the 2nd respondent has to be challenged in accordance with law. Hence, the relief sought for by the petitioner cannot be granted by this Court.
