PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents 1 to 3 to give permission to conduct the Maasi festival to the South Semaputhur Arulmigu Sri Madasamy Thirukovil situate in South Semaputhur, Ettaiyapuram Taluk, Thoothukudi District from 08.03.2024 to 10.03.2024.

This Writ Petition has been filed seeking issuance of a writ of Mandamus, to direct the Respondents 1 to 4 to conduct the Maasi festival to the South Semaputhur Arulmigu Sri Madasamy Thirukovil situate in South Semaputhur, Ettaiyapuram Taluk, Thoothukudi District from 08.03.2024 to 10.03.2024.

2.The learned Government Advocate (Criminal side) on instructions from the Respondent Police submitted that the Tahsildar, Ettaiyapuram Taluk, Thoothukudi District, conducted Peace Committee Meeting in the presence of the Respondents 2 and 3 and in the presence of the Petitioner and the rival parties. The Petitioner on the basis of the Peace Committee talks agreed to hold the Festival on 08.03.2024 to 10.03.2024. The rival parties agreed to hold the festival on 12.03.2024 and 13.03.2024. Both the parties agreed the same before the Tahsildar, Ettaiyapuram Taluk, Thoothukudi District.

3.In the light of the Peace Committee Meeting held before the fourth Respondent, the Tahsildar, Ettaiyapuram as an Executive Magistrate has the power to withhold or to grant permission to conduct the festival to both the parties as agreed before him. The Respondents 2 and 3 are directed to carry forward the Peace Committee Meeting as resolved between the parties before the Tahsildar, Ettaiyapuram Taluk and to grant police protection accordingly.

4.With the above said direction, this Writ Petition is disposed of. No costs.
