ORDER : The Court Made the following order :- This is an application filed by the petitioner to grant bail. The petitioner has been arrested and remanded to judicial custody on 15.03.2015 for the alleged offences punishable under Sections 147, 148, 120(b), 294(b), 324, 307 & 506(ii) of IPC @ 302 IPC, in Crime No.63 of 2015 on the file of the respondent police seeking bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. side) appearing for the State. 3.It is stated in the petition that the case has been registered against the petitioner for the alleged offences punishable under Sections 147, 148, 120(b), 294(b), 324, 307 & 506(ii) of IPC @ 302 IPC. It is also stated that the petitioner is an innocent person and he is a student studying B.B.A in Madurai Institute of Social Sciences. Further, it is stated that examination is to commence from 18.05.2015 onwards and the petitioner has to appear for the examination, otherwise, he will be put to irreparable loss and great prejudice.
4.The learned counsel appearing for the petitioner has submitted that already co accused has been released on bail by this Court in Crl.O.P.(MD)No.9140 of 2015 by order dated 13.05.2015. 5.The learned Government Advocate (Crl.side), on instructions from the respondent Police, has submitted that there are communal problem between two groups and he has raised objection for granting bail to the petitioner, without conditions.
6.On consideration of the above mentioned facts and circumstances and situation of the present case, it is found that the present case is a fit case for grant of bail with conditions. Accordingly, the petitioner is ordered to be released on bail on the following conditions: https://hcservices.ecourts.gov.in/hcservices/
(i) The petitioner shall execute separate personal bond for a sum of Rs.10,000/- (Rupees ten thousand Only) with two sureties for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Madurai. (ii) The petitioner shall appear before the respondent police daily at 6.00 p.m. until further orders.
(iii) The petitioner shall surrender his passport, if any, before the trial Court.
(iv)The petitioner shall not try to intimidate, threat, influence or allure the prosecution witnesses in any manner. (v) In case of any breach or violation of any of the above said conditions, the State would be at liberty to move the Court for cancellation of bail granted to the petitioner. (vi) The petitioner shall make himself available for interrogation by the police officer as and when required.
(vii)The petitioner should furnish his residential address to the investigation officer forthwith by producing the copy of the ration card/Voter ID/Adhar Card/Student ID Card.
