O R D E R
It is brought to the notice of this Court by the learned counsel appearing for the fourth respondent that subsequent to the filing of this writ petition, the fourth respondent has been appointed as Village Assistant at Thonimalai Village.

In this writ petition, the petitioner is seeking only for a writ of declaration to declare the selection and appointment of the fourth respondent to the post of Village Assistant as illegal and consequently, to direct the respondents 1 to 3 to appoint him to the post of Village Assistant at Thonimalai Village.
3. In the affidavit filed in support of this writ petition, the petitioner has not stated as to whether the fourth respondent was appointed to the post of Village Assistant or not. Even, as seen from the counter affidavit
filed filed by the third respondent before this Court, the fourth respondent was appointed to the post of Village Assistant at Thonimalai Village on 23.02.2021, even prior to the filing of this writ petition. The petitioner has also not challenged the appointment order issued to the fourth respondent, which has been enclosed in the typed set of documents filed by the official respondents. The petitioner will have to necessarily challenge the appointment order issued to the fourth respondent to redress his grievance and therefore, the writ of declaration sought for by the petitioner in this writ petition cannot be granted.

Accordingly, this writ petition is disposed of by granting liberty to the petitioner to challenge the appointment order dated 23.02.2021 issued to the fourth respondent appointing the fourth respondent as Village Assistant at Thonimalai Village, in the manner known to him under law. No costs. Consequently, connected miscellaneous petition is closed. 07.11.2025 NCC :
