To modify the condition no.1 imposed against the petitioner to deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs) order passed in Crl M.P No. 7886 of 2024 dt. 18.12.2024 on the file of the Judicial Magistrate, Theni and which is imposed in Cr No. 11 of 2023 on the file of the respondent police against the petitioner. ORDER
This Petition has been filed to modify the condition imposed on the petitioner that the petitioner shall deposit a sum of Rs.2,50,000/- within a period of six weeks from the date on which the petitioner is let out on bail in Crl.O.P.(MD).No.162 of 2025, dated 10.01.2025.
2. Mr.M.S.Senthil Kumar, learned counsel appearing for the petitioner submits that the petitioner is unable to mobilize the funds. Therefore, he prays for the modification of the condition passed in the said petition.
3. Heard Mr.S.S.Manoj, learned Government Advocate (Criminal Side appearing for the State.

Considering the facts and circumstances of the case and taking note of the fact that the learned Judicial Magistrate, Theni, directed the petitioner to deposit a sum of Rs.10,00,000/- in a Fixed Deposit and renew the same until the completion of the case on 18.12.2024 in Crl.M.P.No.7886 of 2024, it is noted that the petitioner failed to comply with this condition. Subsequently, he filed a modification petition before this Court in Crl.O.P.(MD).No.162 of 2025. Taking into account the period of incarceration suffered by the petitioner and his entitlement to statutory bail, this Court on 10.01.2025, modified the condition and directed the petitioner to deposit a sum of Rs.2,50,000/- within a period of six weeks from the date of his release on 2/4
bail. However, the petitioner failed to comply with this condition as well. Therefore, this Court is not inclined to modify the condition stated in the order passed in Crl.O.P.(MD).No.162 of 2025, dated 10.01.2025. The petitioner is directed to comply with the condition as ordered.
