ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 4(1-A) of the Tamilnadu Prohibition Act, in Crime No.71 of 2017, on the file of the respondent police, seeks anticipatory bail.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent/State.
3. The learned Government Advocate (Crl.side) appearing for the respondents states that the petitioner is the sole accused in this case. The petitioner was found in unlawful possession of 140 bottles of brandy containing poisonous substance and the brandy bottles were seized. The petitioner is having similar type of offences in Crime Nos.31/2008 and 253/2008, which are pending for https://hcservices.ecourts.gov.in/hcservices/ investigating officer's examination before the Judicial Magistrate
No.II, Dindigul and Sub Court, Dindigul respectively. The petitioner is also having other similar type of offences in Crime Nos.418 of 2012 and 191 of 2012 and the same are pending for trial before the learned Judicial Magistrate No.I, Dindigul and another case in Crime No.507 of 2015 for the similar type of offence is under investigation. The petitioner was arrested in this case on 25.01.2017 and he is in custody.
4. Considering the above facts and circumstances of the case and also the antecedent of the petitioner in similar type of offence, which are pending trial before the concerned Court, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
