O R D E R

This petition is filed for issuing a direction to the learned Special Judge, Sub Court, Usilampatti, Madurai District to consider the recall warrant petition filed under Section 70(2) Cr.P.C to recall the non-bailable warrant issued against the petitioner in S.C.No.343 of 2013 on the same day.

2. The petitioner admits that he is an absconding accused and that therefore, Non Bailable Warrant was issued against him on 07.10.2013. It is also admitted that the petitioner was not arrested so far. In the circumstances, the petitioner has come forward with this petition.

3. Heard the learned Additional Public Prosecutor appearing for the respondent.

4. When the petitioner is an absconding accused and the Non Bailable Warrant was issued against him long back, the petitioner has to file a petition to anticipatory bail.

5. With the above observation, the Criminal Original Petition is closed.
