Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the fourth respondent to dispose the application in Na.Ka.No.A2/3219/2022 dated 24.11.2022 pending before the fourth respondent and correct the Patta No.5640 and FMB with accurate extent by way of considering the petitioner's applications dated 16.11.2022 and 30.12.2024 within a time stipulated by this Court.

ORDER

The petitioner seeks limited relief of issuance of a Writ of Mandamus to direct the fourth respondent to dispose of the petitioner's application in Na.Ka. No.A2/3219/2022 dated 24.11.2022.

2.Considering the limited scope of the relief sought for in the writ petition, with the consent of the learned counsel on either side, the writ petition is taken up for final disposal at the stage of admission itself. 3.The grievance of the petitioner is that he sold 25 cents in favour of the seventh respondent's husband, in and by way of a registered sale deed. However, patta has been mutated in the name of the seventh respondent's husband for an extent of 28.5 cents, over and above 25 cents, which was alone conveyed to the seventh respondent's husband. Therefore, the petitioner has filed an appeal before the fourth respondent to correct the said extent and limit it to 25 cents and also consequently correct the FMB records. The said application is pending with the fourth respondent from 24.11.2022. It is the further case of the petitioner that though enquiry was conducted, the concerned Tahsildar was transferred and thereafter, there has been no progress.

4.Considering the above circumstances, it would suffice to direct the fourth respondent to conduct an enquiry, based on the petitioner's applications for correction of the extent and in the patta and FMB records and pass orders on 3/6

merits and in accordance with law, after hearing the seventh respondent. The said exercise shall be concluded within a period of eight weeks from the date of receipt of a copy of this order.
