O R D E R
This Writ Petition is filed seeking a direction to respondents to pay additional compensation of Rs.1,65,00,000/- (One Crore and Sixty Five Lakhs only) in respect of petitioner's property acquired for doubling of Dindigul -Villupuram railway line.

It is the case of the petitioner that the property situate in Survey Nos.613/3A1, 613/3A4, 613/3A7 in Ayyalur Village, Vedasandur Taluk, Dindigul District, was acquired for doubling of railway line between Villupuram and Dindukal. The competent authority determined the compensation at Rs.35 lakhs. Since the petitioner is not satisfied with the compensation determined, submitted a representation on 13.02.2023 before the first respondent, seeking enhancement of the compensation. The same has not been considered. Hence, the petitioner has come before this Court.

3. It is not in dispute that an acquisition has been made under the provisions of Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. If any person is aggrieved by the decision of the competent authority determining the compensation amount, he/she must submit an application under Section 8 of the said Act within 60 days before the Collector seeking reference to the Court for enhancement of the compensation. In the case on hand, the petitioner submitted a representation on 13.02.2023, seeking enhancement of compensation before the competent authority viz., first respondent Collector. The same has not been considered. Hence, the petitioner has come before this Court

Since the representation submitted by the petitioner is only an application for enhancement of compensation, without expressing any opinion on the merits of the matter, this Court directs the first respondent to consider the representation of the petitioner dated 13.02.2023, in the light of Section 8 of Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 and pass necessary orders within a period of 8 weeks from the date of receipt of a copy of this order. 3/6
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
