O R D E R

This writ petition has been filed for issuance of a Writ of Mandamus directing the respondent to grant permission and protection for cultural event namely Adalpadal scheduled to be held on 07.05.2018 at night from 9.00 to 1.00 hours in connection with the "Chithirai Festival" in Arulmigu Sri Muthumariamman Temple at Usilampatti Village, Thirumayam Taluk, Pudukkottai District, by considering the petitioner's representation dated 02.04.2018. 2.Heard the learned senior counsel appearing for the petitioner and the learned Government Advocate(Crl.side) appearing for the respondents.

3.According to the learned counsel appearing for the petitioner, the petitioner made a representation dated 02.04.2018 to the respondent to grant permission and protection for cultural event namely Adalpadal scheduled to be held on 07.05.2018 at night from 9.00 to 1.00 hours in connection with the "Chithirai Festival" in Arulmigu Sri Muthumariamman Temple at Usilampatti Village, Thirumayam Taluk, Pudukkottai District. Since no order is passed, the petitioner is before this Court.

4. According to the learned counsel for the petitioner, the representation was given by the petitioner as the member of the Vizha Committee.

5. The learned Government Advocate would submit that the petitioner has given the representation in an individual capacity.

6. This Court has carefully considered the rival submissions made by both sides and perused the materials placed on record.

7. The learned Government Advocate(Crl.side) submitted that the representation has been given in an individual capacity. But for the said submission, no document has been produced by the learned Government Advocate. Per contra, the learned counsel for the petitioner submitted that the representation given by him as the member of the Vizha Committee.

8. In the light of the rival submissions, in the interest of justice it is open to the petitioner to give a fresh representation to the respondent today itself. On receipt of the said representation, the respondent police shall consider the same on merits and in accordance with and pass an appropriate orders on or before 02.05.2018.

9. With the above direction, this writ petition is disposed of. No costs.
