2. The land in question has been acquired under the provisions of the National Highways Act 1956. The compensation payable to the land owners also has been determined. Now the Writ petitioner contends that it should not be disbursed to the fourth respondent. This is because a civil suit is pending between the Writ petitioner and the fourth respondent in O.S.No.24 of 2007 on the file of the V Additional District Court, Madurai.

3. I am of the view that this is a matter that should be determined by the competent authority under Section 3(H)(3) of the National Highways Act 1956. The Writ petitioner has already submitted a representation on 23.01.2019 in this regard. The second respondent shall take a decision under the aforesaid provision on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. The second respondent will hear the Writ petitioner as well as the fourth respondent before passing final orders. It is made clear that this Court has not gone into the merits of the matter.
