Criminal Original Petition filed under section 482 of Criminal Procedure, to direct the Special Judge for Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act Cases i.e., I Additional District and Sessions Judge, Thanjavur to consider the bail application of the petitioners on the same day of his surrender in Crime No. 03 of 2021 on the file of the second respondent police. 1/3
ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. K.M.Karunakaran, Advocate for the Petitioner and of Mr. A.Robinson, Government Advocate (Criminal Side) for the respondents No. 1 and 2, this Court made the following order:
This court by its order dated 25.01.2021, in Crl.OP(MD)No.934 of 2021 directed the petitioners to surrender before the learned I Additional District Judge (PCR Court), Thanjavur within a period of 15 days from the date of receipt of a copy of the order / uploading of the order.
2.The learned counsel for the petitioners would submit that the petitioners were not in a position to surrender before the concerned Court within the time stipulated by this Court and seeks further time to surrender.
3. Considering the request made by the petitioners, the petitioners are directed to surrender before the learned I Additional District Judge (PCR Court), Thanjavur, on or before 07.04.2021, failing which, the order passed by this Court, shall stand automatically cancelled, without further reference to this Court.
