ORDER

The present writ petition has been filed seeking a mandamus directing the Electricity Board to disconnect the service connection given to the 4th respondent for the agricultural lands in S.No.818/2 situated at Periaperali Village, Virudhunagar Circle, Virudhunagar District.

According to the learned Counsel appearing for the writ petitioner, one Mallika and Kamaraj are the owners of the property with whom he has entered into an agreement to purchase the property and he has filed a suit for specific performance as against them in O.S.No.64 of 2024, before the Sub Court, Virudhunagar. He has been put in possession of the property by the said owners. Pending the said suit, the original owners of the property have fraudulently executed a sale deed in favour of the 4th respondent on 03.05.2024 and therefore, he has preferred O.S.No.100 of 2025 before the Sub Court, Virudhunagar, for a declaration that the sale deed in favour of the 4th respondent is null and void and seeking a permanent injunction to protect his possession.

According to the learned Counsel appearing for the writ petitioner, when the civil suits are pending, the respondents 1 to 3 cannot give service connection to the 4th respondent which would affect his rights in the Civil Court. He further submitted that he has filed an application for interim injunction in I.A.No.3 of 2025 in O.S.No.100 and 2025 in which notices have been ordered.

4. The learned Standing Counsel appearing for the respondents 1 and 3 submitted that service connection has been effected last week.

Considering the fact that the civil suit is pending between the parties before the competent civil Court, in case if any interim orders are granted in favour of the writ petitioner with regard to the property in dispute, the respondents 1 to 3 are at liberty to disconnect the service connection given to the 4th respondent.

6. With the above said observations, this writ petition stands disposed of. No costs.
