ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 24.02.2025 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying to grant bail.

2. The petitioner / A10 was arrested and remanded to judicial custody on 20.12.2024, for the alleged offences punishable under Sections 191(2), 191(3), 118(1), 109, 103, 61(2) and 111 of BNS, 2023 and Section 4 of TNPWH Act, 2002 in Crime No.846 of 2024, on the file of the respondent-police.

The case of the prosecution is that on 19.12.2024, at about 8.00 am, when the deceased, along with the defacto complainant, mother of the deceased, were travelling on a two wheeler, the petitioner along with other accused persons were followed them on four wheeler with deadly weapons and committed riot and assaulted the deceased and also committed the murder of the deceased. Hence, the case.

4. Mr.R. Lakshmana Perumal, learned counsel appearing for the petitioner, submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the petitioner has been judicial custody since 20.12.2024. Accordingly, he prays to grant bail to this petitioner.

5. Per contra, Mr.R. Meenakshi Sundaram, learned Additional Prosecutor appearing for the respondent-Police, submits that the petitioner herein has 3 previous cases. He further submits that investigation of the case is pending and therefore, at this stage, if petitioner is released on bail, he may cause threat to the 2/4

defacto complainant and witnesses. Hence, he prays for dismissal of this petition.

6. Heard on both sides and perused the records.

7. This Court has perused the First Information Report. Considering the overt act of the petitioner and also the antecedents of the petitioner, this Court is of the considered view that if bail is granted to the petitioner, he may cause threat to the defacto complainant and witnesses, thereby delaying the investigation. Hence, this Court is not inclined to grant bail to the petitioner.
