ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A8 to A10 apprehend arrest at the hands of the respondent police for the alleged offences punishable under sections 406, 420, 120(B), 467, 468 and 474 of IPC, in Crime No.15 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.The case of the prosecution is that the petitioners along with other accused persons, fabricated documents relating to the property of the de-facto complainant and executed the same as Dhana Settlement and sale deed and thereby cheated the de-facto complainant.
3.The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have nothing to do with the alleged commission of the offence. He further submitted that the petitioners were already granted anticipatory bail by the learned Principal Sessions Judge, Theni, in Cr.M.P.No.878 of 2015, dated 01.04.2015, but they could not surrender and furnish the sureties in time before the court concerned and therefore, the petitioners filed this petition seeking for anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/
4.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
5.Considering the above facts, this court is of the view that this second petition is not maintainable. Hence, this petition is dismissed as not maintainable. However, liberty is given to the petitioners to approach the concerned Sessions Court, by filing application for extension of time.
