ORDER : The Court made the following order :- 1/4

The petitioner, who was arrested and remanded to judicial custody on 17.11.2025 for the offences punishable under Sections 87 of BNS, 2023, Section 3(a) r/w 4(2) of the Protection of Children from Sexual Offences Act, 2012, Section 5(m) r/w Section 6 of the Protection of Children from Sexual Offences Act, 2012, Section 351(3) of BNS, 2023, in Crime No. 17 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner physically abused the victim girl. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 17.11.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the victim is 7 years old and he has produced the 164 statement of the victim girl and he opposed for grant of bail to the petitioner.

5. After perusing the 164 statement, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed. 24.02.2026 PJL TO
