Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to take all effective appropriate steps to remove the illegal encroachments made in the public road running from Kambiliampatti Village via Kattupatty particularly in S.No.1867/1, 1864/23, 1864/29 and 1866/23 of Kambiliampatti Village, Sanarpatti Union, Dindigul East Taluk, Dindigul by considering the representation of the petitioner and signed by other general public dated 19.02.2018 within a stipulated as that may be fixed by this Court.

ORDER

(Order of the Court was made by C.T.SELVAM, J.) By consent, Writ Petition itself, is taken up for final disposal.

2. Mr.R.Sethuraman, Learned Additional Government Pleader takes notice for respondents 1 to 4 and Mrs.J.Padmavathi Devi, Learned Special Government Pleader takes notice for fourth respondent.

3. The Writ Petitioner seeks issuance of a Writ of Mandamus, directing the respondents to take all effective appropriate steps to remove the illegal encroachments made in the public road running from Kambiliampatti Village via Kattupatty particularly in Survey Nos.1867/1, 1864/23, 1864/29 and 1866/23 at Kambiliampatti Village, Sanarpatti Union, Dindigul East Taluk, Dindigul by considering the representation of the petitioner, signed by other general public, dated 19.02.2018.

4. Though the petitioner seeks a direction for a larger relief, learned counsel for petitioner would submit that petitioner would limit his prayer to one, seeking consideration of representation dated 19.02.2018.

5. Learned Additional Government Pleader seeks time towards consideration of the representation.

6. Accordingly, the Writ petition shall stand disposed of directing the respondents to consider the representation of the petitioner dated 19.02.2018 solely on merits and pass orders in accordance with law, within a period of 4 weeks from the date of receipt of a copy of this order. No costs.
