O R D E R

The present Writ Petition has been filed seeking a Mandamus as against the respondents 1 and 2 to disburse five fixed deposit amount and one savings bank account with suitable interest which are standing in the name of the petitioner's mother on the basis of the representation dated 24.02.2023.

2. The petitioner's mother namely, Kandhamaniyammal, was having five fixed deposit amount and one savings bank account amount in the second respondent bank. She had passed away on 30.12.2017, leaving behind the petitioner and the respondents 3 to 5 herein as the legal heirs. The husband of Kandhamaniyammal has predeceased him.

3. According to the learned counsel appearing for the writ petitioner, the amount lying in the savings bank account may be disbursed to the writ petitioner and the respondents 3 to 5 equally.

4. The learned counsel appearing for the third respondent submits that he is abroad and therefore, his share may be retained by the second respondent bank.

In view of the above said submissions, the respondents 1 and 2 herein are directed to release 1/4th share of the fixed deposit amount and savings bank account amount each to the writ petitioner and the respondents 4 and 5. 1/4th share of the third respondent viz., K.R.Kandhavel shall be retained by the bank and the same may be disbursed as and when he appears before the bank. The bank shall disburse the amount on production of original FD receipts, death certificate and legal heirs certificate of deceased Kanthamani Ammal.

6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
