The present writ petition has been filed seeking a Mandamus directing the first respondent to process the petitioner's passport application dated 26.04.2022.
2. The learned Government Advocate (Criminal Side) appearing for the second respondent brought to the notice of this Court that the petitioner has been implicated in a criminal case in Crime No.339 of 2020 on the file of the second respondent police, which has culminated in filing of a charge sheet before the juvenile Justice Board on 07.10.2022. So far, for the past three years, charge sheet has not been taken on file.
3. Considering the fact that the petitioner was juvenile at the time of offence and for the past three years charge sheet has not been taken on file, there is no legal impediment for the first respondent to consider the application of the petitioner for issuance of passport. 2/4
4. In view of the above said facts, the first respondent is directed to consider the passport application of the petitioner dated 26.04.2022 and pass orders within a period of four weeks from the date of receipt of a copy of this order.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
