ORDER : The Court Made the following order :- The petitioner who is the sole accused, apprehends arrest at the hands of the respondent police for an alleged offence punishable under Sections 294(b), 506(ii) of IPC and Section 4 of TNPPDL Act in Crime No. 179 of 2015, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner have damaged the two wheeler of the de facto complainant to the tune of Rs.60,000/-.
3. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl. side) appearing for the respondent.
4. The learned counsel for the petitioner submitted that the petitioner and the de facto complainant are neighbours and he has been falsely implicated in this case.
5. The learned Government Advocate (Crl. Side) would submit that the investigation of the case is pending.
6. Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Sattankulam and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to https://hcservices.ecourts.gov.in/hcservices/
the satisfaction of the learned Magistrate concerned and the petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Crime No.179 of 2015 and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
