:Respondent / Respondent PRAYER:- Civil Revision Petition filed under Article 227 of the Constitution of India to direct the Principal District Court, Kanyakumari District at Nagercoil to expedite and complete the application in I.A.No.1 of 2021 in O.S.No.9 of 2012 on the file of Principal District Judge, Kanyakumari District at Nagercoil within the time frame stipulated by this Court.

ORDER

This revision has been filed seeking a direction to the Principal District Court, Kanyakumari District at Nagercoil to expedite and complete the application in I.A.No.1 of 2021 in O.S.No.9 of 2012 on the file of Principal District Judge, Kanyakumari District at Nagercoil, within a specified time fixed by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the 2nd respondent.

3. The petitioner has filed the said Interlocutory Application in I.A.No.1 of 2021 to delete the entry made in the Encumbrance Certificate. Already, in appeal there is a direction that the attachment shall stand raised. The petitioner has filed this petition only to delete the wrong entry in the encumbrance certificate and hence, this Court is inclined to allow this petition.

Accordingly, the Civil Revision Petition is allowed and the Principal District Judge, Kanyakumari District at Nagercoil is directed to dispose the application in I.A.No.1 of 2021 in O.S.No.9 of 2012 pending on his file, within a period of 15 days from the date of receipt of a copy of this order. No costs.
