PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to cancel the 3rd respondent's council meeting held on 13.02.2026 and conduct fresh council meeting for the discussion within the time frame fixed by this Court. ORDER
The present writ petition has been filed seeking a mandamus directing the respondents to cancel the third respondent council meeting held on 13.02.2026 and to conduct a fresh council meeting for the discussion.
2. According to the learned Counsel appearing for the writ petitioner, on 13.02.2026, there was a scuffle in the meeting hall and therefore, the meeting ended abruptly and no resolutions were passed. However, the 4th respondent has recorded as if the 75 resolutions have been passed on the said date. Therefore, the present writ petition has been filed.

The learned Counsel appearing for the 3rd and 4th respondents submitted that out of 33 members, 28 members have supported the resolution and therefore, all the 75 resolutions were passed on 13.02.2026. 5 of the members have opposed the resolutions. The petitioner is one among the 5. Therefore, according to the learned Counsel appearing for the 3rd and 4th respondents, the resolutions have been passed with the support of majority of the members and therefore, there is no necessity to cancel the meeting that was conducted on 13.02.2026.
4. The learned Counsel appearing for the writ petitioner submitted that the meeting ended abruptly and therefore, he had lodged a complaint to the respondents 1 and 2 on 14.02.2026. Those representations have been forwarded to the District Collector, Tenkasi District, and the petitioner has been called upon to appear for the enquiry.
5. In view of the above said facts, the District Collector, Tenkasi District, is suo-motu impleaded as the 5th respondent. The 5th respondent is directed to consider the request of the petitioner after giving due opportunity to the other members of the Municipality and pass orders within a period 4(four) weeks from the date of receipt of a copy of this order. 3/5
6. With the above said observations, this writ petition stands disposed of. No costs.
