Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 to A5, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 176, 201 of I.P.C., in Crime No. 784 of 2017, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that A1's wife was died on 24.10.2017. After her death, A1 burned the body of the deceased, without informing the police law enforcing agency. Thereafter, on Suspect, the Village Administrative Officer, initiated proceedings under Section 176 Cr.P.C and registered a case under Section 201 of I.P.C.

3. The learned counsel appearing for the petitioners would submit that A1's wife had committed the suicide by consuming poison leaving behind her female child and thereafter, A1 and his relatives burned the body of the deceased. He would further submit that the petitioners are innocent persons and they are no way connected with the offence, as alleged by the prosecution.

4. The learned Government Advocate (Crl.Side) appearing for the State would submit that the proceeding under Section 176 of Cr.P.C

is under enquiry and that the offence under Section 201 of I.P.C is a bailable one. Hence, the petition filing for anticipatory bail, does not arise.
